1.1 These Terms of Service (“Terms”) govern the legal relationship between the Fit GorillAI mobile application (“App”) and the user (“User”, “you”).
1.2 Fit GorillAI is a mobile fitness application that provides AI-powered workout program generation, exercise tracking, nutrition logging, sleep monitoring, and Apple HealthKit integration services.
1.3 By downloading, installing, or using the App, you declare that you have read, understood, and accepted these Terms.
The App provides the following services:
3.1 You may sign in to the App using Google Sign-In or Apple Sign-In methods.
3.2 You must be at least 16 years of age to use the App.
3.3 You are responsible for maintaining the security of your account. You are responsible for all activities performed under your account.
3.4 If you detect unauthorized access to your account, you must immediately notify us at aifitapp@protonmail.com.
4.1 You are obligated to provide accurate and up-to-date profile information.
4.2 You agree to use the App only for lawful purposes.
4.3 You agree not to use the App in a manner that would infringe on the rights of third parties.
4.4 You agree not to engage in activities that would compromise the security of the App, overload the servers, or disrupt the normal operation of the service.
5.1 Fit GorillAI is a fitness and healthy living tracking application. The information, workout programs, and recommendations provided by the App do not constitute medical advice.
5.2 It is strongly recommended that you consult a healthcare professional before starting any exercise program.
5.3 Individuals with chronic conditions, who are pregnant, or who have recently undergone surgery must obtain medical approval before following programs in the App.
5.4 Fit GorillAI cannot be held responsible for any injury, health problem, or adverse outcome resulting from following workout programs. It is your responsibility to assess your own health condition during exercise and to stop when necessary.
6.1 Workout programs are automatically generated by artificial intelligence based on your profile, preferences, and historical data.
6.2 AI-generated programs are recommendations only; they do not replace the advice of a professional trainer or dietitian.
6.3 Profiling activity is carried out during the program generation process. Your physical data, workout history, and preferences are automatically analyzed. Your rights regarding this are explained in detail in our Privacy Policy.
6.4 No guarantee is given that specific fitness outcomes will be achieved. Results may vary from person to person.
7.1 Fit GorillAI offers a two-tier subscription model: free and premium (Pro).
7.2 Pro subscriptions are billed through the Apple App Store. Payment transactions are processed through Apple's payment infrastructure.
7.3 Subscriptions auto-renew unless cancelled at least 24 hours before the renewal date.
7.4 To cancel your subscription, go to App Store > Your Account > Subscriptions.
7.5 Refund requests are subject to Apple's refund policy. Refunds are processed directly through Apple.
7.6 We reserve the right to change subscription prices with reasonable prior notice.
8.1 With your permission, the App reads the following data types from Apple HealthKit: sleep data, step count, active energy (calories), exercise duration.
8.2 HealthKit data access is provided through the iOS permission mechanism. You may revoke permission at any time via iOS Settings > Privacy > Health.
9.1 All intellectual property rights, including the design, source code, graphics, logo, content, and branding of the Fit GorillAI application, belong to Fit GorillAI.
9.2 Data entered by the user (workout logs, nutrition logs, profile information) remains the property of the user.
9.3 Copying, modifying, distributing, reverse-engineering, or creating derivative works from any part of the App is prohibited.
10.1 The App is provided “as is” without warranties of any kind.
10.2 Fit GorillAI cannot be held liable for any direct, indirect, incidental, special, or consequential damages arising from your use of or inability to use the App.
10.3 Fit GorillAI's total liability shall in no event exceed the amount you paid for the subscription in the last 12 months.
10.4 No guarantee of uninterrupted, error-free, or secure service is provided.
11.1 You may delete your account at any time through the App settings.
11.2 We reserve the right to suspend or terminate your account with prior notice if you violate these Terms.
11.3 Upon account termination, your personal data will be deleted immediately in accordance with our Privacy Policy.
Fit GorillAI cannot be held liable for failure to perform obligations due to unforeseen, unavoidable events beyond the control of the parties, including but not limited to natural disasters, war, terrorism, pandemics, government decisions, internet infrastructure failures, and power outages.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
14.1 We reserve the right to update these Terms as necessary.
14.2 Significant changes will be communicated through in-app notifications.
14.3 Your continued use of the App after changes constitutes acceptance of the updated Terms.

5.3 Kronik rahatsızlığı olan, hamile veya yakın zamanda ameliyat geçirmiş kişiler, Uygulamadaki programları takip etmeden önce tıbbi onay almalıdır.
5.4 Fit GorillAI, antrenman programlarını takip etmenin sonucunda oluşabilecek herhangi bir yaralanma, sağlık sorunu veya olumsuz sonuçtan sorumlu tutulamaz. Egzersiz sırasında kendi sağlık durumunuzu değerlendirmek ve gerektiğinde durmak sizin sorumluluğunuzdadır.
6.1 Antrenman programları, profiliniz, tercihleriniz ve geçmiş verileriniz temelinde yapay zeka tarafından otomatik olarak oluşturulur.
6.2 AI tarafından oluşturulan programlar yalnızca öneri niteliğindedir; profesyonel bir antrenör veya diyetisyenin tavsiyesinin yerini almaz.

7.1 Fit GorillAI, ücretsiz ve premium (Pro) olmak üzere iki katmanlı abonelik modeli sunmaktadır.

7.3 Abonelikler, yenileme tarihinden en az 24 saat önce iptal edilmedikçe otomatik olarak yenilenir.

11.1 Hesabınızı istediğiniz zaman Uygulama ayarlarından silebilirsiniz.

Fit GorillAI, doğal afetler, savaş, terör, salgın, hükümet kararları, internet altyapı arızaları ve elektrik kesintileri dahil ancak bunlarla sınırlı olmamak üzere, tarafların kontrolü dışında öngörülemeyen ve önlenemez olaylar nedeniyle yükümlülüklerin yerine getirilememesinden sorumlu tutulamaz.
Bu Koşulların herhangi bir hükmü geçersiz veya uygulanamaz bulunursa, geri kalan hükümler tam yürürlükte kalmaya devam edecektir.
14.1 Bu Koşulları gerektiğinde güncelleme hakkımızı saklı tutarız.
14.2 Önemli değişiklikler uygulama içi bildirimler aracılığıyla size iletilecektir.
14.3 Değişikliklerden sonra Uygulamayı kullanmaya devam etmeniz, güncellenmiş Koşulları kabul ettiğiniz anlamına gelir.
